Terms of Service
These Terms of Service govern your use of the Expansion OS website and software (the Service). Please read them carefully.
1. Agreement to these terms
By creating an account, purchasing a subscription or using the Service, you agree to these Terms. If you use the Service on behalf of a business, you confirm you have authority to bind that business to these Terms.
2. The Service
Expansion OS is subscription software for contractors that may include a CRM, two-way texting, missed-call text-back, quotes, invoices, payment links, automations, review requests and related tools. Features vary by plan. We may improve, change or retire features over time.
3. Your account
You agree to provide accurate information and keep it current. You are responsible for your logins, for everyone you give access to, and for all activity under your account.
4. Subscriptions and billing
Plans are billed in advance on a monthly or yearly basis to the payment method on file and renew automatically until cancelled. Prices are shown at signup. Taxes may apply.
5. Founding member pricing
Founding member pricing stays locked for as long as your subscription remains active and in good standing. If you cancel and later return, current pricing applies.
6. Usage-based charges
Texting, calling, email, AI and similar usage beyond any credit included in your plan is billed based on usage. Usage may be charged from a prepaid balance that recharges automatically when it runs low.
7. Cancellation
You may cancel at any time. Cancellation takes effect at the end of your current billing period, and you keep access until then. Except as stated in Section 8, payments are non-refundable.
8. 30-day money-back guarantee
New customers may request a refund of their first subscription payment within 30 days of their initial purchase by contacting us. The guarantee does not cover usage-based charges or third-party card processing fees and applies once per business.
9. Messaging and calling compliance
You are responsible for getting any required consent before you text, call or email your customers through the Service, and for following applicable laws and carrier rules, including the TCPA, CAN-SPAM and A2P 10DLC requirements. We may suspend messaging that violates these rules.
10. Payments you collect
Card payments you collect through the Service are processed by third-party payment processors under their own terms. Processing fees apply to each transaction.
11. Acceptable use
You may not use the Service for unlawful activity, spam, harassment, deceptive marketing, or to send content you do not have the right to send, or attempt to disrupt or gain unauthorized access to the Service.
12. Your data
You own the customer data you add to the Service. You give us permission to host, process and back up that data only as needed to provide and support the Service. You can request an export of your data.
13. Third-party services
The Service relies on third-party providers for hosting, messaging, phone, email and payments. We are not responsible for outages or changes caused by those providers.
14. No guarantee of results
The Service is provided as is and as available. We do not guarantee any specific number of leads, jobs, reviews or revenue.
15. Limitation of liability
To the fullest extent allowed by law, our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental or consequential damages, including lost profits.
16. Suspension and termination
We may suspend or end access to the Service for non-payment or for breach of these Terms. You may stop using the Service at any time.
17. Changes to these terms
We may update these Terms. We will post the updated version on this page with a new date. Continued use of the Service after an update means you accept the updated Terms.
18. Governing law
These Terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in San Diego County, California.
